Terms of service

1. Eligibility and Accounts

  • You must be at least 18 years old (or have parental/guardian consent) and capable of entering a binding contract under Australian law.
  • You are responsible for keeping account login details secure and for all activity under your account.
  • We may suspend or terminate accounts for breach of these Terms, fraud, or illegal activity.

2. Orders, Contract Formation, and Acceptance

  • Display of products on the Site is an invitation to treat, not an offer.
  • Your order is an offer to purchase. A contract is formed only when we accept your order (e.g., by sending an order confirmation email or dispatching the goods).
  • We may decline or cancel any order (including for pricing errors, stock unavailability, suspected fraud, or inability to deliver) and will notify you and refund any payment taken.
  • You must provide accurate delivery and contact information. We are not responsible for delays or non-delivery caused by incorrect information you supply.

3. Pricing, GST, and Payment

  • Prices are in Australian dollars (AUD) and include GST unless otherwise stated.
  • The total price (including GST, shipping, and any mandatory charges) will be shown before you complete checkout. We do not engage in drip pricing.
  • Payment is due at the time of order via the methods we offer (e.g., credit/debit card, PayPal, Afterpay, or other processors). Payment processors have their own terms.
  • We reserve the right to correct obvious pricing errors. If we have accepted an order at an incorrect price, we may cancel it and refund you.
  • Title to goods passes to you on full payment and delivery (or as otherwise stated). Risk of loss or damage passes on delivery to you or your nominated address (or earlier if you arrange collection).

4. Delivery, Shipping, and Risk

  • Delivery timeframes are estimates only and not guarantees (except where a specific time is agreed). We will use reasonable efforts to meet them.
  • Shipping costs and options are shown at checkout. International shipping (if offered) may involve customs duties, taxes, or restrictions payable by you.
  • Risk of loss or damage to goods passes to you upon delivery to the address you provide (or collection).
  • If goods are damaged in transit or not received, contact us promptly with proof so we can assist (carrier claims may apply).

5. Australian Consumer Law (ACL) – Consumer Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These non-excludable guarantees include (among others) that goods:

  • Are of acceptable quality (fit for all the purposes for which goods of that kind are commonly supplied, acceptable in appearance and finish, free from defects, safe, and durable);
  • Match their description, sample, or demonstration model;
  • Are fit for any particular purpose you made known to us (or for which we represented they are fit);
  • Come with clear title and undisturbed possession (subject to any disclosed security interests).

For services (if applicable): they must be provided with due care and skill, be fit for purpose, and be supplied within a reasonable time.

These rights cannot be excluded, restricted, or modified by these Terms. Any term that attempts to do so is void. Statements such as “no refunds”, “all sales final”, or time limits that purport to override consumer guarantees for faulty goods are not enforceable and may be misleading.

If goods or services fail to meet a consumer guarantee:

  • For a major failure, you may choose a refund or replacement (for goods) or cancel and obtain a refund for the unused portion (for services), plus compensation for reasonably foreseeable loss.
  • For a minor failure, we may repair or replace (or re-supply services) within a reasonable time. If we fail to do so, you may cancel and obtain a refund.

Contact us promptly with details and proof of purchase. We will assess claims in accordance with the ACL. You may also have rights against the manufacturer.

6. Change-of-Mind Returns and Our Returns Policy

  • Change-of-mind returns are not required by the ACL and are at our discretion (or as stated in our separate Returns Policy, if any).
  • If we offer change-of-mind returns: [specify conditions, e.g., unused/unopened goods in original packaging within X days, customer pays return shipping, restocking fee if any, exclusions for personalised/perishable/sale items].
  • Faulty or non-compliant goods are handled under the ACL consumer guarantees above (no restocking fees or “opened/used” bars that conflict with the ACL).
  • We will not charge processing, restocking, or repair fees for valid consumer guarantee claims, and we will not require you to pay return shipping for major failures or where the goods are not of acceptable quality (we will arrange or reimburse reasonable costs).

7. Warranties Against Defects (Voluntary Warranty)

If we offer an additional voluntary warranty against defects (beyond the ACL guarantees), it will be set out separately and must include the mandatory ACL wording and required information (business details, what we will do, how to claim, period, etc.). Any voluntary warranty is in addition to your ACL rights and does not limit them.

8. Intellectual Property

  • All content on the Site (text, images, logos, product descriptions, design, software) is owned by us or our licensors and protected by Australian and international intellectual property laws.
  • You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent, except for personal, non-commercial use of the Site.
  • Product images and descriptions are illustrative; slight variations may occur.

9. Acceptable Use of the Site

You must not:

  • Attempt to gain unauthorised access, introduce malware, scrape data, or interfere with the Site;

  • Use automated systems without permission.

We may suspend or terminate access for breaches.

10. Limitation of Liability

Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the ACL or other laws that cannot be excluded.

To the maximum extent permitted by law:

  • Our liability for any claim arising out of or in connection with these Terms or the supply of goods/services is limited to (at our option) repair, replacement, re-supply, or refund of the price paid;
  • We are not liable for indirect, consequential, special, or pure economic loss (including loss of profits, data, or opportunity), except to the extent caused by our negligence or wilful misconduct or as required by the ACL;
  • Our total aggregate liability is limited to the amount you paid for the relevant goods/services.

This does not affect your ACL rights for major failures or compensation for reasonably foreseeable loss.

  • We may withdraw or change promotions at any time.
  • Gift cards (if offered) are subject to their own terms and any applicable expiry or residual value rules under Australian law.

13. Force Majeure

14. Termination and Cancellation

  • You may cancel an order before it is accepted or dispatched (subject to any non-refundable customisation costs).

  • These Terms (together with any order confirmation and our Privacy Policy) constitute the entire agreement between us regarding the subject matter.
  • No waiver is effective unless in writing.
  • You may not assign your rights without our consent. We may assign our rights.
  • Electronic communications (including order confirmations) satisfy any writing or signature requirements under the Electronic Transactions Act 1999 (Cth) and equivalent State laws.
  • Headings are for convenience only.

By placing an order or using the Site, you acknowledge that you have read, understood, and agree to these Terms.
